Order in Council 1692 - New Lease of the Windsor Branch


In 1913, the DAR-held lease of the Windsor Branch between Windsor and Windsor Junction would expire at the end of December. A new lease was negotiated which included considerable new expenditure by the DAR on the branch. The lease was for 99 years at an annual rate of $22,500. The approval was granted in a Federal Order in Council number 1692 of the year 1913. (Orders in Council are numbered beginning from number 1 each calendar year.)

Below is the text of the approval signed by the Prime Minister and the deputy Governor General.

On a memorandum dated 2nd July, 1913, from the Minister of Railways and Canals, representing that, under an agreement between His Majesty and the Dominion Atlantic Railway Company, dated 13th December, 1892, which agreement expires on the 31st December, 1913, the Windsor Branch from Windsor to Windsor Junction, N.S., about 31 miles in length, has been operated by the said Company, though maintained by His Majesty.

The Minister states that, in order to place this Branch in a satisfactory condition, an expenditure of approximately $300,000 is required, and negotiations have been had with the Company for the expenditure of the requisite amount by them, and their future maintenance, as well as operation, of the Branch in consideration of their obtaining a lease of the Branch for a period of 99 years, they agreeing to pay for the privilege the sum of $22,500 a year, in equal quarterly payments.

The Minister, on the advice of the General Manager of Government Railways, recommends that, subject to the grant of the necessary legislative authority from Parliament, which authority it is understood the the Government and the Company will endeavour to obtain, and subject to confirmation by the votes of the

the shareholders of the Company, and to approval by the Governor in Council of its terms, he be authorized to enter into such lease with the Company, accordingly, on the terms above mentioned, a provision to be embodied therein to the effect that if, upon the expiration of the said term of 99 years, or other termination of the lease, no renewal thereof is agreed upon, the lessor shall pay to the lessee a sum equal to the aggregate of all the moneys expended by the lessee with the approval of the lessor on Capital or Improvement account in connection with the railway demised during the twenty-five years next preceding such expiration or determination.

The Committee submit the same for approval.
