1910 Nova Scotia Chapter 136 - An Act Respecting the North Mountain Division of the Dominion Atlantic Railway

An Act was approved by the Nova Scotia legislature on March 30th 1910 to allow the municipality of Kings County to raise money to pay for the cost of lands and damages for private land taken for the proposed North Mountain Division Branch (Weston Subdivision) of the Dominion Atlantic Railway. A significant amount of text in the act deals with different tax rates to be applied to different wards of the county, presumably because the different wards would benefit more or less from the new railway line.

This Act seems to have replaced a 1908 act, Chapter 132 of 1908.

Summary of sections of Chapter 136 Acts of 1910

An Act Respecting the North Mountain Division of the Dominion Atlantic Railway.

(Passed the 30th day of March, A. D. 1910.)

The preamble says the Municipality of Kings County held a special session on February 16, 1910 and passed a resolution asking that the county be authorized to borrow money and pay to the DAR the costs and damages of the railway taking private lands for its right of way and stations.

Section 1 references Chapter 101 of the Acts of Canada 1908, and says money payable for lands for track and station purposes and terminals shall be a charge on the county. The county will assess on its ratepayers taxes sufficient to pay the cost of the lands taken. Different parts of the county had different rates. One half of the total was assessed on wards 3 (15 cents per hundred dollars of assessment), 4 (45 cents per hundred), 5 (25 cents per hundred) and 14 (15 cents per hundred). The other half was to be assessed equally on the other wards of the county, except for ward 11, which was to be one-half of the rate of those other wards.

Section 2 references the Nova Scotia Railways Act as applying to the construction of the new railway, but not exceeding 1000 feet in length and 200 feet in breadth for station grounds, and not exceeding 10 acres for a terminal at the Western end.

Section 3 references Chapter 101 of the Statutes of Canada for 1908 and the Nova Scotia Railways Act, saying the DAR can take whatever lands were needed for its railway. The railway must file plans as required under the NS Railways Act.

Section 4 sets out a procedure for the appraising the value of the lands and damages by appointing three arbitrators who would examine the lands and make appropriate awards.

Section 5 requires the county treasurer to collect the moneys from the assessments mentioned in section 1 and pay them out to the affected landowners,

Section 6 requires the new railway to be complete and ready for operation in two years from June 1, 1910.

Section 7 is a blanket section saying existing Acts or parts of Acts not consistent with this current act are repealed.
