1899 Nova Scotia Chapter 98 - An Act to authorize the Municipality of West Hants to borrow money to pay railway damages for land taken for the Midland Railway
An Act was approved by the Nova Scotia legislature on March 30th 1899 to allow the municipality of West Hants to borrow money to damages for private land taken for the Midland Railway Company. The ”Whereas” sections:
The first whereas mentions section 32 of Chapter 85 of the Acts of 1896 – the incorporation of the Midland Railway Company. That section provided money payable for lands for track and station purposes would form a county charge in the counties through which the line passed.
The second whereas says the council of West Hants municipality passed a resolution authorizing the acquisition of lands for the railway and granting a free right of way for the said railway through the said municipality.
The third and fourth whereas clauses dealt with appointment of arbitrators and their appraisement and award.
The fifth whereas clause says now the municipality must borrow money to pay the costs (the damages).
Section 1 of the act confirmed the award of the arbitrators.
Section 2 authorized the municipality to borrow eleven thousand dollars to pay for the lands and damages.
Section 3 instructed the municipality to issue debentures for the money.
Sections 4 and 5 gave details of the value of the various debentures and an annual interest rate of four percent, paid twice yearly. The debentures (in various amounts) were to mature one by one over a total period of 20 years.
Section 6 instructed the municipality to so arrange its tax assessments to include sums sufficient to pay the interest and principal of the debentures.
Sections 7, 8 and 9 had details of how the borrowed sums were to be held temporarily and paid out to the owners and tenants of the lands affected.
Section 10 allowed the municipality to pay money for any particular property of which the ownership of which was unclear, unknown, or which owner refuses the amount to the supreme court for Hants county and the municipality would then not bear further responsibility.
Section 11 dealt with how the county supreme court was to pay out the money.
Section 12 allowed further borrowing by the municipality if the railway should require further lands for railway purposes beyond what was already taken.
